UNITED SIKHS Files Writ of Mandate to Protect CDL Holders From Arbitrary Revocations

UNITED SIKHS, partnered with attorneys specializing in DMV procedures in California to file a writ of mandate on behalf of a legal permanent resident (LPR) whose commercial driver’s license (CDL) was first cancelled, then reissued, on March 3, 2026 only to be revoked on the same day.
The driver had his CDL reissued on March 3, 2026, and went to work that afternoon only to be told by his employer that he could not drive and might face prosecution for driving without a license. He received no prior warning that his CDL would be revoked.
“This case highlights the arbitrary nature of the agencies’ actions,” said Manvinder Singh, UNITED SIKHS’ Regional Director. “Unlike the broad California class action challenging mass cancellations of CDLs, who are referred to as “nondomiciled” by the new FMCSA rule that in effect excludes a vast majority of immigrant drivers from obtaining a CDL, this case focuses on an individual whose legal permanent residency should have protected him,” he said.

Drivers who follow the law should not be placed at risk of criminal liability or job loss because an agency has the ability to issue and revoke a driver’s license on the same day, without notice or hearing. We are seeking to restore fair process and the ability to challenge decisions before they can harm hardworking individuals,” said Director Bhupinder Kaur.
