UNITED SIKHS and U.S. Law Firms Investigate Denial of Commercial Driver’s Licenses to Lawful Permanent Residents

UNITED SIKHS, in collaboration with law firms across the United States, has launched an investigation into a growing number of cases involving the denial or cancellation of Commercial Driver’s Licenses (CDLs) for lawful permanent residents (LPRs). These actions appear to stem from the implementation and interpretation of a federal rule issued by the Federal Motor Carrier Safety Administration (FMCSA), which advocates say is being applied in ways that unfairly exclude immigrants from obtaining or maintaining CDLs.
In one case currently pending in California, a Sikh commercial driver was denied a CDL after the California Department of Motor Vehicles refused to accept his expired Permanent Resident Card (green card) along with an official notice from U.S. Citizenship and Immigration Services (USCIS) extending the card’s validity. Together, these documents establish lawful permanent resident status under federal law. Despite this, the DMV declined to issue the license.
A writ petition was filed in California in March 2025, challenging the denial. The matter is scheduled to be heard this week before the Honorable Karin Schwartz in Sacramento County Superior Court.
In a separate case under investigation in Indiana, the Indiana Bureau of Motor Vehicles (BMV) has moved to cancel the CDL of a lawful permanent resident, citing discrepancies between the individual’s documentation and federal SAVE system records. The driver has been attempting to resolve the issue with USCIS for more than four years and remains in administrative limbo, unable to correct the mismatch despite repeated efforts.
UNITED SIKHS and its legal partners are evaluating potential legal remedies and policy advocacy to address these systemic barriers. The organization is also urging federal and state agencies to provide clearer guidance and ensure that valid immigration documentation, including extension notices issued by USCIS, are properly recognized in licensing decisions.

ਇਹ ਮੁਸ਼ਿਕਲਾਂ ਫੈਡਰਲ ਮੋਟਰ ਕੈਰੀਅਰ ਸੇਫਟੀ ਐਡਿਮਿਨਸਟੇਸ਼੍ਰਨ (FMCSA) ਦੁਆਰਾ ਜਾਰੀ ਕੀਤੇ ਗਏ ਇੱ ਕ ਸੰ ਘੀ ਿਨਯਮ ਦੇ ਲਾਗੂ ਕਰਨ ਨਾਲ ਹੋਈਆਂ ਹਨ ।ਿਜਸ ਬਾਰੇ ਵਕੀਲਾਂ ਦਾ ਕਿਹਣਾ ਹੈ ਿਕ ਇਹ ਿਨਯਮ ਇਸ ਤਰਾਂ੍ਹ ਲਾਗੂ ਕੀਤਾ ਿਗਆ ਹੈ ਿਜਸ ਨਾਲ ਿਸੱ ਧੇ ਤੌਰ ‘ਤੇ ਪੱ ਕੇ ਪਵ੍ਰਾਸੀ CDLs ਪਾ੍ਰਪਤ ਕਰਨ ਜਾਂ ਜਾਰੀ ਰੱ ਖਣ ਤੋ ਬਾਹਰ ਹੋਣਗੇ ।

CDL ਦੇਣ ਤੋਂ ਇਨਕਾਰ ਕਰ ਿਦੱ ਤਾ ਿਗਆ ਸੀ ਿਕਉਂਿਕ ਉਸ ਦੇ ਸਥਾਈ ਿਨਵਾਸੀ ਕਾਰਡ (ਗੀ੍ਰਨ ਕਾਰਡ) ਦੀ ਿਮਆਦ ਿਨਕਲ ਚੱ ੁਕੀ ਸੀ। ਉਸ ਦੁਆਰਾ ਕਾਰਡ ਦੀ ਿਮਆਦ ਨੰ ੂ ਵਧਾਉਣ ਲਈ ਯੂਐਸ ਿਸਟੀਜ਼ਨਿਸ਼ਪ ਐਡਂ ਇਮੀਗੇਸ਼੍ਰਨ ਸਰਿਵਿਸਜ਼ (USCIS) ਿਵੱ ਚ ਅਰਜ਼ੀ ਲਗਾਉਣ ਦੇ ਬਾਵਜੂਦ ਵੀ ਕੈਲੀਫੋਰਨੀਆ ਦੇ ਮੋਟਰ ਵਾਹਨ ਿਵਭਾਗ (DMV)ਨੇ ਉਸਨੰ ੂ ਲਾਇਸੈਂਸ ਜਾਰੀ ਕਰਨ ਤੋਂ ਇਨਕਾਰ ਕਰ ਿਦੱ ਤਾ। ਜਦ ਿਕ ਉਸ ਨੇ ਲਾਈਸੈਂਸ ਦੀ ਵੈਧਤਾ ਵਧਾਉਣ ਲਈ ਸਾਰੇ ਜ਼ਰੂਰੀ ਦਸਤਾਵੇਜ ਲਗਾਏ ਸਨ ਅਤੇ ਇਹ ਸਾਰੇ ਦਸਤਾਵੇਜ਼ ਕਾਨੰ ੂਨੀ ਤੌਰ ‘ਤੇਜਾਇਜ਼ਸਨ।
ਮਾਰਚ 2025 ਿਵੱ ਚ ਇਸ ਸਾਰੇ ਮਾਮਲੇ ਿਵੱ ਚ ਇਨਕਾਰ ਨੰ ੂ ਚੁਣੌਤੀ ਦੇਣ ਲਈ ਕੈਲੀਫੋਰਨੀਆ ਿਵੱ ਚ ਇੱ ਕ ਿਰੱ ਟ ਪਟੀਸ਼ਨ ਦਾਇਰ ਕੀਤੀ ਗਈ ਹੈ। ਿਜਸਦੀਸੁਣਵਾਈਇਸਹਫ਼ਤੇਸੈਕਰਾਮੈਂਟੋਕਾਉਂਟੀਸੁਪੀਰੀਅਰਕੋਰਟਿਵੱ ਚਮਾਨਯੋਗਕਿਰਨਸ਼ਵਾਰਟਜ਼ਦੇਸਾਹਮਣੇਹੋਣੀਹੈ।
ਇਸੇ ਤਰਾਂ੍ਹ ਇੱ ਕ ਹੋਰ ਮਾਮਲਾ ਇੰ ਡੀਆਨਾ ਿਵੱ ਚ ਜਾਂਚ ਅਧੀਨ ਹੈ।ਇਸ ਮਾਮਲੇ ਿਵੱ ਚ ਇੰ ਡੀਆਨਾ ਿਬਊਰੋ ਆਫ਼ ਮੋਟਰ ਵਹੀਕਲਜ਼ (BMV) ਨੇ ਇੱ ਕ ਕਾਨੰ ੂਨੀ ਤੌਰ ‘ਤੇ ਪੱ ਕੇ ਿਨਵਾਸੀ ਦੇ CDL ਨੰ ੂਰੱ ਦਕਰਿਦੱ ਤਾਹੈ।ਇਹਕਿਹਕੇਿਕਉਸਦੇਦਸਤਾਵੇਜ਼ਕਾਨੰ ੂਨਅਨੁਸਾਰਿਸਸਟਮਿਵੱ ਚਸੁਰੱ ਿਖਅਤਪਏਿਰਕਾਰਡਨਾਲਨਹੀਂਿਮਲਦੇ।
ਇਹ ਡਰਾਈਵਰ ਚਾਰ ਸਾਲਾਂ ਤੋਂ ਵੱ ਧ ਸਮੇਂ ਤੋਂ USCIS ਨਾਲ ਇਸ ਮੱ ੁਦੇ ਨੰ ੂ ਹੱ ਲ ਕਰਨ ਦੀ ਕੋਿਸ਼ਸ਼ ਕਰ ਿਰਹਾ ਪਰ ਪਸ਼੍ਰਾਸਕੀ ਅੜਚਣਾਂ ਕਾਰਨ ਕਈ ਵਾਰ ਕੋਿਸ਼ਸ਼ ਕਰਨ ਕਰਨ ਤੇ ਵੀ ਦਸਤਾਵੇਜ਼ ਦਰੁਸਤ ਨਹੀਂ ਹੋ ਰਹੇ।ਯੂਨਾਈਿਟਡ ਿਸੱ ਖਸ ਦੇ ਰਾਸ਼ਟਰੀ ਕਾਨੰ ੂਨੀ ਮਾਿਹਰ ਡਾਇਰੈਕਟਰ, ਵਾਂਡਾ ਸਾਂਚੇਜ਼ ਡੇ ਨੇ ਿਕਹਾ ਿਕ, ” ਇਹਨਾਂ ਮਾਮਿਲਆਂ ਤੋਂ ਇਹ ਪਤਾ ਲੱ ਗਦਾ ਹੈ ਿਕ ਇਹ ਕਾਨੰ ੂਨੀ ਤੌਰ ‘ਤੇ ਪੱ ਕੇ ਿਨਵਾਸੀਆਂ ਲਈ ਪਰੇਸ਼ਾਨੀ ਦਾ ਕਾਰਨ ਬਣ ਰਹੇ ਹਨ ਜਦ ਿਕ ਉਹ ਕਾਨੰ ੂਨੀ ਿਨਯਮਾਂ ਅਨੁਸਾਰ ਸੰ ਯੁਕਤ ਰਾਜ ਿਵੱ ਚ ਰਿਹਣ ਅਤੇ ਕੰ ਮ ਕਰਨ ਲਈ ਪੂਰੀ ਤਰਾਂ੍ਹ ਅਿਧਕਾਰਤ ਹਨ। ਸੰ ਘੀ ਢਾਂਚੇ ਦੀਆਂ ਕਮੀਆਂ ਉਹਨਾਂ ਦੇ ਰੋਜੀ ਰੋਟੀ ਕਮਾਉਣ ਦੇ ਸਾਧਨ ਿਵੱ ਚ ਰੁਕਾਵਟ ਬਣ ਰਹੀਆਂ ਹਨ।”
